Terms of Use
Effective October 12, 2026
These Terms of Use govern your access to and use of navcasting.com, navcasting.info and any related website operated by Thea Portfolio Analytics, LLC, a Wisconsin limited liability company (“Thea,” “we,” “us”), and all content on it (the “Site”). By using the Site you agree to these Terms. If you do not agree, do not use the Site.
1. Information only — not advice
The Site and its content, including estimates, research, charts, case studies, example reports and demonstrations (“Content”), are provided for general information and research purposes only. Nothing on the Site is investment, financial, legal, tax, accounting or valuation advice, a recommendation to buy, sell or hold any security or fund interest, or an offer or solicitation of any kind. Thea is not acting as your investment adviser or fiduciary, and no such relationship is created by your use of the Site. Consult your own professional advisers before making any decision.
2. Estimates, not facts
The fair value of a private fund cannot be directly observed. Our NAVcasts™ and other figures are statistical estimates produced by models from data and assumptions; they are not prices, appraisals or audited values, and they may differ materially from values reported by fund managers or realized in any transaction. Some Content is based on simulated or historical data. Past results, back-tests and accuracy statistics do not guarantee future results.
3. No reliance
You are solely responsible for any decision you make and for any use of the Content. You agree not to rely on the Content as the sole or primary basis for any investment, valuation, reporting or other decision.
4. No warranty
The Site and all Content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted, secure or error-free.
5. Limitation of liability
To the fullest extent permitted by law, Thea and its members, managers, officers, employees, advisors, contractors and licensors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, investment value, data or goodwill, arising out of or relating to the Site or the Content, however caused and on any theory of liability, even if advised of the possibility of such damages. Our total liability arising out of or relating to the Site or the Content will not exceed one hundred U.S. dollars (US$100).
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you; in that case our liability is limited to the maximum extent permitted by law.
6. Your indemnity
You agree to defend, indemnify and hold harmless Thea and its members, managers, officers, employees, advisors, contractors and licensors from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Site or the Content, your reliance on it, your breach of these Terms, or your violation of any law or third-party right.
7. Intellectual property and permitted use
The Site and Content are owned by Thea or its licensors and protected by intellectual-property laws. NAVcast™, NAVcasting™ and our logos are our trademarks. You may view the Site and quote brief excerpts for non-commercial research or commentary, provided you cite Thea Portfolio Analytics as the source. You may not, without our prior written permission: copy, republish or redistribute the Content beyond such excerpts; build any product, index, dataset or service from it; scrape, crawl or systematically extract it; use it to train or improve any machine-learning or artificial-intelligence model; reverse-engineer our methods; or remove any notices.
8. Third-party content and links
The Site refers to third-party research, publications and websites. We do not control and are not responsible for them, and a reference does not imply endorsement. Use of any third-party resource is subject to its own terms. Nothing on the Site grants you any right to any third-party data.
9. Client services
Access to our portal, reports, data, API, Excel add-in and connectors is provided only under a separate written agreement with Thea. If that agreement conflicts with these Terms, the agreement governs those services.
10. Changes and availability
We may change, suspend or remove the Site or any Content, and update these Terms, at any time. The “Effective” date above shows the latest version. Continued use of the Site after a change means you accept the updated Terms.
11. Governing law and venue
These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Wisconsin for any dispute arising out of or relating to the Site or these Terms, and you waive any objection to venue there.
12. General
If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permissible and the rest will remain in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and us about the Site. You may not assign them; we may.
